1. The following terms and definitions are referred to in these General Terms of Payments:
a. Radboudumc: Stichting Radboud universitair medisch centrum, a foundation, also referred to as Radboud university medical center, located at Nijmegen (525GA), the Netherlands, at Geert Grooteplein Zuid 10 (Mailbox 9101, 6500HB Nijmegen), registered in the trade register of the Dutch Chamber of Commerce under number 80262783, including the subsidiaries that it manages or over which it has predominate control;
b. Opposite Party: the natural or legal person with whom Radboudumc enters into a contract.
2. These General Terms of Payment apply to all contracts between Radboudumc and the Opposite Party to the extent that they relate to hospital admission and/or outpatient or clinical treatment, supplying goods (including medicines, bandages, prosthetics, medical devices, etc.), providing services to the Opposite Party and, in general, everything done and/or provided by or on behalf of Radboudumc for which the Opposite Party is billed. All such contracts between Radboudumc and the Opposite Party are subject to Dutch law and the competent court of the District Court of Gelderland.
3. Any deviation from these General Terms of Payment is valid only if Radboudumc has agreed to this in writing. The Opposite Party’s General Terms or Terms of Purchase do not apply and are expressly dismissed.
4. Payment by the Opposite Party must be made without suspension or settlement within 30 days of the date of invoice by a bank transfer to the bank account number shown on the invoice.
5. At any time that Radboudumc feels reasonably motivated, it is authorized to request the Opposite Party to pay a full or partial advance or security on the estimated costs of (further) treatment, research and/or goods and/or (other) services provided to or still to be provided to the Opposite Party.
6. If the Opposite Party fails to make (full) payment within 30 days of the date of invoice, it is legally in default and, effective on the due date, it will owe the statutory interest on the outstanding amount. The Opposite Party bears all of the costs incurred by Radboudumc in connection with the extrajudicial and/or judicial collection costs, including any turnover tax owed on these costs. The extrajudicial collection costs amount to at least 15% of the principle amount due, with a minimum of €150.00 excluding VAT. If the Opposite Party is a natural person that does not exercise a profession or a company, then he/she is in default once the 14-day recovery period following the receipt of the summons has expired. The maximum collection costs to be billed are in accordance with what has been established by law.
7. As soon as the Opposite Party is in default, all claims and future claims of Radboudumc against the Opposite Party are immediately due and payable without notice of default or any other prior statement being required. Radboudumc is also authorized to suspend any obligations arising from any contract entered into with the Opposite Party until full payment of all due and payable claims has been received.
8. Objections to an invoice or to the amount billed must be sent in writing to the financial correspondence address shown on the invoice within 14 days of the date of invoice. Objections to an invoice or to the amount billed do not suspend the payment obligation.
9. In connection with collection costs, Radboudumc is authorized to provide important information to the organization(s) charged with making the collection, this in compliance with the related privacy regulations.
10. Without further notice, Radboudumc is authorized to adjust the rates for nursing, research and/or treatment in accordance with the amounts shown on the websites of Radboudumc.

The amounts shown on the above-mentioned websites are based on the applicable price guidelines established by the Nederlandse Zorgautoriteit (NZa) [Dutch Healthcare Authority] or by another legal body and are in accordance with the applicable rate agreements with healthcare insurers.
11. Radboudumc may assume that the billing and address information provided by the Opposite Party are correct until the Opposite Party sends any changes in writing to the financial correspondence address shown on Radboudumc’s invoice.
12. In accordance with Article 11, paragraph 1, under c, g 1o and o 1o of the Turnover Tax Act, Radboudumc is exempt from VAT for treating and nursing patients, services provided to its patients by healthcare professionals registered under the BIG Act and professional medical education.
